Terms and Conditions

1. Scope and Validity of the Terms

1.1. These Terms apply to the legal relations arising between a person (hereinafter Client) and the owner of the online store www.glukoosimonitor.ee (hereinafter e-shop), Medivar OÜ (hereinafter Seller), in connection with the purchase of products via the e-shop.

1.2. In addition to these Terms, the legal relations arising from product purchases through the e-shop are governed by the legislation in force in the Republic of Estonia.

2. Products

2.1. Product prices are in euros and include VAT according to Estonian law.

2.2. Product prices and availability may change without prior notice.

2.3. Product images in the e-shop are for illustrative purposes only and may differ slightly from actual products (depending on screen settings).

3. Placing an Order

3.1. To order goods, add the desired products to the shopping cart. To complete the order, fill in the required fields and choose a suitable delivery method. The screen will then display the total amount, which can be paid securely using the following payment methods:

Payments are processed by Montonio Finance OÜ. Payment takes place outside the E-shop in a secure environment – in the respective bank’s environment when paying via bank link, and in Montonio Finance OÜ’s secure environment when paying by credit card. The Seller does not have access to the Client’s bank or card details. The agreement enters into force once the amount due has been received in the E-shop’s account.

Medivar OÜ is the controller of personal data and forwards the necessary personal data for payment processing to the authorized processor, Montonio Finance OÜ.

4. Delivery of Products

4.1. Delivery time is 1–5 working days.

4.2. Products are delivered to the Client via Smartpost parcel machines.

4.3. The Client must verify the accuracy of the contact details provided before placing an order to avoid delays or misunderstandings in delivery. The Seller is not liable for delivery delays or misunderstandings caused by incorrect or inaccurate details provided by the Client.

4.4. The Client becomes the owner of the goods after payment.

5. Right of Return – 14 Days

5.1. The Client has the right to withdraw from the contract within 14 days from the date of receiving the goods (hereinafter 14-day right of return), subject to the following terms.

5.2. By purchasing from the e-shop, the Client agrees to the following return conditions:

5.2.1. Returned goods must be unused and in original packaging (the Client must carefully open the package without damaging it. If the package cannot be opened without damage, the returned product does not need to be in the original packaging).

5.2.2. If the product has been used for purposes other than checking its nature, characteristics, and functioning, or shows signs of use or wear, the E-shop has the right to reduce the refund amount proportionally to the decrease in value.

5.2.3. To return a product, please fill in a withdrawal form and send it to info@glukoosimonitor.ee to arrange further steps. Products can be physically returned to our office at Laki 30 (by prior arrangement) or via SmartPOST, DPD, or Omniva parcel machines.

5.2.4. A refund will be made to the Buyer’s account within 14 days of receiving the withdrawal form. Return shipping costs are borne by the Buyer.

5.3. The 14-day return right does not apply to items not suitable for return for health or hygiene reasons once opened after delivery (e.g., cosmetics, underwear, swimwear, face masks).

5.4. If the Buyer fails to collect the package from the parcel machine within the designated time and the goods are returned to the Seller, the Buyer must pay for shipping again if they want the goods re-sent. In case of cancellation, the shipping fee will not be refunded.

6. Warranty

6.1. Warranty provider: Medivar OÜ, Laki 30, 12915, Tallinn.

6.2. To exercise warranty rights, contact Medivar OÜ (glukoosimonitor.ee, info@glukoosimonitor.ee; +372 6606070).

6.3. The warranty gives the consumer the right to request repair or replacement under the warranty terms. Free of charge repair/replacement does not apply to worn parts, damage caused by misuse, drops, or improper use. Defects caused by manufacturing will be rectified free of charge. The reason for the defect is determined by the manufacturer or Seller’s expert. Shipping costs for sending the product under warranty are covered by the warranty provider.

6.4. Warranty rights must be exercised by contacting the warranty provider.

6.5. Warranty validity is two years, starting from the handover of the product to the Buyer. The warranty period is suspended during the time the Buyer cannot use the product due to a defect covered by the warranty.

6.6. Warranty is valid in Estonia and other EU countries.

6.7. In addition to warranty rights, consumers have statutory rights (e.g., the right to file complaints under the Law of Obligations Act § 218).

7. Liability and Force Majeure

7.1. The Seller and Client are liable for damages caused by breaching these Terms under applicable Estonian law.

7.2. The Seller is not liable for damages or delays in delivery caused by circumstances beyond its control, unforeseen, or unavoidable (force majeure).

8. Processing of Personal Data

8.1. By entering data in the e-shop and confirming, the Consumer grants the right to collect and process personal data (name, phone number, delivery/home address, email) and forward this to the logistics partner for delivery.

8.2. The E-shop has the right to use the Consumer’s address for sending advertising or other information.

8.3. The Consumer may withdraw consent for data processing at any time, except when necessary for enforcing claims or delivery.

8.4. Direct marketing by email is only carried out with the Consumer’s explicit consent.

8.5. Encrypted communication with banks ensures the security of bank details. The E-shop does not have access to them.

9. Complaints Procedure

9.1. The E-shop is liable for non-conformity or defects in products sold to the Consumer that appear within two years of delivery. For the first six months, defects are presumed to have existed at delivery unless proven otherwise by the E-shop.

9.2. The Consumer must notify the E-shop of defects within two months of detection and provide proof of purchase (invoice).

9.3. The Consumer must stop using the defective product.

9.4. Repair or replacement of defective goods is agreed upon between the E-shop and Consumer. Repair costs are covered by the E-shop.

9.5. The E-shop is not liable for defects caused by improper storage or misuse by the Consumer.

9.6. To file a complaint, email info@glukoosimonitor.ee with the Buyer’s name, phone number, order number, and defect description.

9.7. Complaints must be filed within two months of discovering the defect.

9.8. Complaints will be reviewed, and the Consumer contacted within 14 days.

9.9. The Consumer may demand a price reduction or refund if the E-shop cannot repair or replace the item, if repair/replacement fails, is delayed, or causes unreasonable inconvenience.

10. Terms of Use and Changes

10.1. By purchasing from the e-shop, the Consumer agrees to these Terms and Conditions.

10.2. The sales contract between the Seller and Client takes effect once payment is received.

10.3. The Seller may change the Terms and product prices. Updates are published on the e-shop. The terms and prices valid at the time of purchase apply.

10.4. The Seller may cancel an order if a technical error displayed an incorrect price.

11. Other Provisions

11.1. If the e-shop refuses to resolve a Consumer complaint, or the Client disagrees with the offered solution, the Client may file a complaint with the Consumer Disputes Committee via the Consumer Protection and Technical Regulatory Authority or go to court.
